Two court case decisions changed the way the federal government considers nonprofits. They state that 501(c)3 status equates to organizations being federal assistance recipients. These cases were decided in Maryland and California. They will most likely be appealed.

If these cases hold, nonprofit schools would be subject to Sec 504 of the Rehabilitation Act, Title IX, Title VI, FERPA, etc.

This Amicus Brief was generated by the National Association of Independent Schools in support of appeal to those court decisions. This letter of support for the Amicus Brief was signed by many proponents of private education, including WFIS.
